Why our Indian Judiciary is rejecting again and again the proposal of repaying the investors?

Sahara Chief Mr. Subrata Roy is showing his willingness to repay and the company is appealing to the judicial system to consider the proposal. Why so stubborn behavior for the parivaar?
The company in every aspect has always worked for the upbringing of the society. Why it will not give transparency to its own investors, I don’t think there is any need of running away, as every dimensions of the company is doing well and has equivalent profits.
 Who doesn't have ups and downs in life? Every problem can be sorted out by finding solutions.  Why the proposals is not being accepted.  Mr. Subrata Roy has done so much for the company, and now he is framed with allegations.
 I don’t understand, investors have signed after agreeing all the terms and conditions and none of them has complained till date, then why now such a huge fuss and venom for the group? 
Every issue can be resolved then why not this?  Sahara Chief has willingly surrendered and requested for the apologies of not appearing before the court. He has only asked for some time, If SEBI wanted then this issue can be sorted out long back.
In its order dated 4th February, 2014, the Supreme Court itself granted liberty to Sahara “for mentioning the matters for preponement of the date if a concrete and acceptable proposal can be offered in the meantime”. However, when Sahara came up with a proposal and mentioned the matter for preponement of the date, in full allegiance to the said order, the Supreme Court astonishingly got infuriated and termed the mentioning as its ‘insult’. Is the court not in contempt of itself?

Previously also I was inspired by the literacy camps and facilities provided to the weaker sections. The Sahara India Pariwar Group always inspires me to do something bigger but also teaches to be grounded and work for the societal development.
I hope every student in every part of India gets the enlighten with the knowledge, and enrols themselves in Q education for deeper learning perspective with high end state of art infrastructure.
Education is important; I think the group is doing a noble job of sowing the seeds of literacy even in the remotest area.  When I will complete all my years of education, I would like to the part of esteemed organisation.

The round of applause producing the loudest volume was what everyone in my family doing at the time when the news of P V Sindhu winning the bronze medal in World Badminton Championships , were flashed on very news channels. Multiple sounds of fireworks, whistles, cheering noises from neighborhood filled our hearts with contentment & exhilaration. No other could be a better reason to party harder.

P V Sindhu being the first India to win the women’s singles medal had brought added to the glory of our country.

Wait!! The list of victory has not stopped here. One more hat of appreciation was added on Sindhu’s head when She was recommended for the prestigious Arjuna Award, post her bronze medal feat at the World Championship in Guangzhou, China.

The proud moment felt by all Indian when P V Sindhu carried the tricolor forward made more proud to the Man behind the camera who chose her as the Icon Player by Sir Subrata Roy- chairman and managing director of the Giant Sahara India Pariwar, for his Franchise Awadhe Warriors.

Awadh Warriors fetched the 18 year old for a whopping USD 80,000 in the IBL auction and the correctness of the great decision maker, Mr. Roy,  gained faith on the blossoming Hyderabadi, on achievement of her giant-killer tag in the world badminton.

The satisfaction of the Subrata Roy’s decision flashed when he stated that, “We are confident that she will continue to win more laurels for the country.”

SAHARA - SEBI: THE MURDEROUS POUND OF FLESH

As funny as it may appear but the Sahara Sebi issue strangely reminds me of Shakespeare’s “Merchant of Venice”. For those who did not comprehend the context, I’ll draw the parallel for you. SEBI disguised as the vindictive, devious Shylock, drags Antonio (in this case Sahara) to reinforce his absurd claim to Antonio’s 1 pound of flesh (interestingly the pound of flesh here refers to the approximately 20,000 crores). As readers, we all knew that Shylock was nothing short of killing Antonio in the court of law. A befitting analogy to the Sahara Sebi dispute.
As preposterous as the title may sound, the witch hunt against the Sahara supremo, Subrata Roy Sahara, is inches away of being an ill intentioned corporate honour killing in progress by the highest authorities perched in position of power and clout in India. A vicious attempt to execute an entire corporate just to see it go on its knees bleeding, only to entertain the prejudicial whims of a few.
Before this takes any form of further elaboration, an immediate look at the economic quicksand we as an economy are in may add some perspective to what you all will feed your minds with further down this piece. On one hand, unemployment, fiscal deficits, an all time low in entrepreneurship and inflation are some of the fiends we hope to fight off in the ongoing elections. The gap between the haves and the have nots only deepens. On the other hand, we have a senseless, irrational litigation running in the courts against Sahara at the behest of SEBI, which until now has served absolutely no purpose, lacks any grain of logic or fiscal sensibility and appears to be making a mockery of our judicial system.
The Supreme Court epitomizes the judicial soul of the country.  An extremely powerful entity that has the privilege and the clout of imparting judicial discourse and lending sensibility in much senseless times we live in. What does not make sense is when these minds of logic and intellect facilitate in pronouncing judgement and infer, rather impose, guilt upon Sahara without any grain of proof and assist an absurd claim of a regulator to a pound of flesh that a) only reveals the regulator’s prejudicial & draconian approach towards fiscal regulation in a free democratic country and b) severely impairs the business sensibilities and economics of growth and development.
Subrata Roy, perhaps is the only corporate leader who comes from the region of UP, Bihar, Rajasthan or MP. He can be attributed to have brought UP onto the map of corporate leadership apart from its pre-existing electoral might that UP is already known for. He has infact spawned employment for thousands of people, catalyzed entrepreneurs, contributed massively to state revenues and GDP and heavily fuelled CSR initiatives not just at a state but at a national level too. He has gifted the poor with economic empowerment and generated a fiscal device of investment and savings for these have nots.
SEBI’s claims about Sahara’s business practices hold no metal & more dangerously are premised on an assumption. Having failed to verify the thousands of documents and the veracity of the Sahara investors, SEBI has assumed to put the blame of its malfunction on an assumption that these investors are “fictitious”. This coming from the national regulator is an extremely hazardous premise. How can a regulator be so negligent and irrational in hurling such grave allegations when they themselves have not fulfilled the obligations of due diligence that is pending at their end.
Having failed to do so, they have not only declared a war against a corporate whose business, in the absence of any proof, stands absolutely legitimate but have also cloaked their incompetency by pronouncing Sahara guilty. Again, no proof of that too!
Assumptions are dangerous toys in the hands of a mindless child here. It is the knife with which SEBI intends of extract its pound of flesh. For moment here, let’s walk into the dangerous premise of that assumption and assume that SEBI is granted its wish. It takes its pound of flesh of Sahara. Sahara compromises and pays the disputed amount to SEBI. Now, having done that what I would really like to know is how does SEBI plans to distribute this money amongst the investors, who it in the first place, according to SEBI, were fictitious? More so, if even we assume that by some work of miracle they do locate these investors, shoves the money down their throats which, to begin with, these depositors intended to keep invested, where do these depositors take this money? This question is important because these investors are daily rickshaw pullers, small roadside vendors and daily wage earners who probably do not hold a 7 vault safe in their houses. If they have permanent houses in the first place is also dubious. They are not account holders and definitely lurking around the poverty line. Has SEBI worked on an alternate investment plan for these investors if they wish to continue investing their money? How does SEBI plans to ensure the financial health, whatever little they may have? For future where do these small depositors go for their savings because the only avenue they had as Sahara is already standing with more than its pound of flesh missing and hemorrhaging to death?
A regulator and especially the courts cannot drop the burden of substantial proof, moral & social obligations of their assessments and most certainly cannot entertain prejudicial whims and eccentricities. Their roles have been carved and evolved in a democratic society only to protect, serve and nurture. Witch hunts and executions have no room where “Where words come out from the depth of truth, Where tireless striving stretches its arms towards perfection, Where the clear stream of reason has not lost its way, Into the dreary desert sand of dead habit...”.

SAHARASHTRA & THE DOMINOS EFFECT

Newton's third law of motion in very simple words states, "Every action has an opposite and equal reaction". So what happens when the most prudent, judicious minds sitting in the seats of power and influence exert abnormal & irrational force under the mistaken notion of justice and propriety? The answer...?? Its SAHARASHTRA.
SAHARASHTRA (Sahara for the Rashtra) or simply translated to "Sahara for the Nation". A Corporate where every breathing soul unites to leverage an opposite and equal force on these powers at play. A corporate whose leadership has always served in the best interests of the nation, economic empowerment for one & all, is ambitious, united and not afraid to think out of the box. But sadly, regulators like SEBI appear to have no qualms quashing such entrepreneurial spirit and have suddenly donned the role of suffocating a thriving conglomerate rather than being your model constructive regulator.
Coming back to the SAHARASHTRA & THE DOMINOS EFFECT. For most who din't know, Sahara India Pariwar has a dedicated workforce that runs into lacs of people. Coupled with the families that are associated with this workforce, their daily bread and butter comes from this mammoth corporate. Now, this number comfortably swells up to many many lacs of people. So much so that if collected together in one place these lacs & lacs of people can comfortably (theoretically speaking) create a city in its self. Surprisingly, SEBI does not fathom or rather has no intention of gauging the devastating effects its contorted sense of propriety can have on these many millions of lives.  Imagine this city created by these lacs & lacs of people was called SAHARASHTRA.
The folks of SAHARASHTRA have been a blessing to the national economy. To begin with, the money generated alone from the Income Tax that is paid by each member of Sahara India in the last decade, if clubbed together, probably runs into hundreds of crores (courtesy Sahara India as one the biggest employment generators in the country). These households, individually, themselves create thriving opportunities and revenues at a state and national level on many fronts - Retail, Infrastructure, Housing, Small scale industries (as small as a papad or spices made by these small scale industries goes into all of these SAHARASHTRA households); Education, adding to the literacy quotient of the state and the nation; Savings & Bank Deposits & Investment Generation; contribution to Travel & Tourism (when these families chose to take family vacations); creation of daily/low wage employment opportunities for house-helps/maids,cooks,drivers; support to senior citizens who themselves wield immense spending power; reflecting the spending power of the Average Indian (they do not forget their weekly outings to movies, restaurants & other family fun stuff) & most certainly infusion and preservation of the national cultural diversity. The list is endless. Imagine, children being educated in these households could be our future leaders, sportspersons, thinkers, innovators & inventors & artists. The possibilities are limitless and the future effects these households exercise on the makeup of India have a staggering, compounding DOMINOS EFFECT..!!!!

It is obnoxious when you hear worst comments about Sahara that has been an essential part of India development to success

Yes, I am talking about Sahara group who has been excellent towards their work when it comes to building the country be it in social terms or the athletic terms.
I am an athlete from Hyderabad, It was an honor for me to receive a support from the sahara group for my training into the athletic field. Also, I have been reading news about sahara been sponsoring a number of activities related to the Olympics. It gives immense motivation and moral support to the athlets of India when such companies come forward and give their helping hands in order to grow and improve the country’s image worldwide.
 I know with their support many of the dynamic players like me have got motivation because the group has given spectacular support. With hockey they also supported cricket, they were concerned with the players also. 
It has not only boost the motivational spirits in the athletes but it has also motivated me to work hard towards the goal of achieving more and more gold medals and  even I have the aspiration of adding feather to the cap of India’s image.
In India, after the efforts of the largest Parivar people Hockey was given equal attention by the people, their sponsorship uplifted the woman and men efforts of participating in the sports. My only one message to some corrupt beaurecrats.  Remember the common man has still has the power to reunite and support for the righteous things and right people.  I know the recent times are hard for Subhrato Royji, his family and giant parivaar. I will always continue my support for the group as they have done many things for dynamic talents like us.

I am an educated working woman who is supported by Sahara

 I am aware about the recent conspiracy that is being created for big reputed firm Sahara and Subrata Roy.  In my opinion the firm has always shown their willingness of repaying to its investors with various schemes? Why is their honesty taken for granted?
I have invested earlier in the schemes of Sahara and will still continue investing with the group entities. My previous experience was good and very transparent. I don’t think there is any point of cheating their own investors, when they such a huge empire of business dimensions.
They profit well for every lateral. Then why they will make fussy statements and fake policies?  I know many people who are being investing from decades and not suffered any problems.
It is being first time in the history when so many people have to be paid and there are no complains of the masses. Isn’t it some kind of trick to bully the group image and the humble person like Subhrato Roy?
No one is seeing his willing proposals to pay to its investors, is this part of democracy even the court has several times rejected it. SEBI calls himself a watch market regulators, what was he is doing for several years, why the matter is now bought on limelight?
Why so rudeness now, where was the system when he bought good major changes in the country and employment opportunities even in the rural areas?
Why the government did not take any initative of appreciating his good deeds during promotion of our national games.  The people were not even informed about his major contribution and help.  Subhrato Roy  took up several projects for the development of the country as whole. Why no attention was given at that time, even he started from scratch and developed his empire with the balance of helping others.

I am a media Journalist by profession and I am with Sahara

I saw thousands of people dead after the incident. The site was displeasing, as hundreds of people were still searching their fellow mates; the survivors were asking help to get basic things like water and food.
Government and army were putting their efforts but due to weather conditions still many flood affected areas for not getting help.  Later the huge Sahara India Parivaar joined in the rescue operations. During the uttrakhand floods I was asked to report the coverage.  I followed the instruction of my boss and went to the flood affected place.
Great strength I was seeing of their workforce and amazing team work. Nearly one lakh bottled water and food packages, free medicines were distributed.
In addition they even extended the help for installing the mobilization units for health problems and team of qualified doctors as the condition of people were detonating.
Yes, the team had great power of human resources also to help the people who were stuck with the floods. First time in my history of reporting I was seeing large number of corporate employees working for the betterment of the society.  When everybody could only assume, they felt the pain of the people and worked being responsible Indian citizen.
Being emotional human being first, I will continue my patronage and warm support for the group. I wish the group emerges soon. The judicial system accepts their proposals and grants great relief to the team and the chairman Sahara Sri.
Does the market regulator has the privilege of changing its own statement again and again?  Till date all the 22k Crores and now how come 37k Crores came into picture?  Why so retrospective effects, when the problems could have been solve earlier also.
SaharaSri never ran away from any situations, and always willed to be conversant with the Media. 

My dream career path was Sahara

I am a MBA student, studying in Mumbai and based in Ahemdabad. I had visited the Aamby Valley City a township developed by the Sahara India Pariwar in Pune district.
The scenic beauty and architecture is prompting the excellence in the management of this particular township. The golf course spread across several acres, the shalleys, the amazing ambiences in the restaurants and the renowned light and sound show.
It was an amazing experience and it was one of the most professionally handled townships I have come across. The claims against sahara group are completely vague for me because I have seen the professionalism they follow and it does not convey they that would fraud their customers who have faith in sahara group.
Sahara group of Subrata Roy is an extreme professional organization; there is hardly any possibility of a fraud. Even if there’s delay in payment to the investors it had been because of the crucial projects Sahara is been taking up for the development of India as a whole. That absolutely does not mean the company is drowning the trust of the investors. We live in a society which believes only what they to believe, be it the truth or just a negative masked image of a company or a person. The negative image is just “created” and people are bound to believe it because of the strong media attention that it gets to make these negative images.
I truly support sahara group and believe that it is time to be independent in our thoughts and think of all the perspectives before getting into the conclusion that the media draws. We must have our own backed up experience in order to claim sahara as fraud, not just because the media says it. As a young individual my belief will stay with the company because it is backed by a lot of good deeds than the bad.

I don’t have more patience now! Why the plan of Sahara was rejected?

I have been affiliated with Sahara for more than a decade now, everything is so transparent between us, I cannot even imagine of Sahara doing a scam with its investors. It’s a common sense, no one really wants their customer to make unhappy.
Subrata Roy never had/have short term money making plans, why sahara would play the game knowing that they would lose their investors, I mean nobody does that. Can’t people understand the simple logic? Why to allege the innocent with the lame accusations? Sahara is paying now for its modesty towards all. Well, there is something phishy or I must say everything is phishy because I have been two years now and the same debate is on and on. There isn’t any problem on planet earth that cannot be resolved by mutual discussion but SEBI isn’t ready for the same. What is Subrata Roy suppose to do when anything isn’t accepted: the refund proposal, bail, next hearing.
The sole allegations were appended by Mr. Abraham, I wonder if he is of SEBI or Some Italian lady? He took the case of just Sahara out of many, there are many pending cases and files that are yet to be processed, why Abraham overlooked those ones?
Some people feel it’s a great work done by Abraham? But I feel it is just a lame thing to increase the number of pages in portfolio of Mr. Abraham. If he had been that great than he would have given the sole stats with accurate figures and their reasons, anyone can write a 100 page book
Also, what is going on in NSE and BSE? A SHARE GOES UP 16% AND COMES DOWN 16%. Is this not gambling? If u were really interested in the safety of investors u should have only delivery based buying or selling so these speculations and money loss of small investors would not happen.
The sole thing happened because Saharashri Subrata Roy dared to say that Italian lady isn’t the legitimate heir for the position of PM few years back.

SAHARA-SEBI STANDOFF | VIEW & COUNTER-VIEW

The Supreme Court is set to hear Sahara chief Subrata Roy’s petition on Tuesday. Sahara has raised some points over its legal battle with stock market regulator Sebi
  • Sahara says it has already paid 93% of the investors. Per investor average deposit is of 8,400. Hence, it can be repaid in cash as per law 
  • In last 17 months, Sebi repaid only 1 cr and is holding 5619 cr (including interest), argues Sahara 
  • No verification process has been started by Sebi in the last 17 months, disobeying court’s August 31, 2012 order, the company says 
  • Sahara offered guarantee of the entire amount through bank trustee security; but when it was rejected, the company says it offered irrevocable bank guarantee. This has not been accepted 
  • At the heart of the matter lies Sebi’s demand, under directions of the Supreme Court, of an additional 20,000 crore along with 15% interest to investors 
  • The company says Sebi has alleged that Sahara’s investors are fictitious and untraceable 
  • Sahara says that in 2008, it had repaid around 4 crore depositors under supervision of the Reserve Bank of India 
  • The company says in response to Sebi’s assertion that many of the 20,000 letters to depositors didn’t elicit a response, Sahara had submitted affidavits and KYC documents confirming their existence 
  • Sahara says it remains Sebi’s responsibility to ascertain the authenticity of its claim that it has repaid most of their money
    If Sebi continues to insist that investors do not exist, then, by the same logic, the regulating body — born out of the specific mandate of protecting investors — also ceases to have any further stake or role to play in the case, the company said in a statement 
  • Sahara says a proper verification process has not been implemented to ascertain the existence of its depositors — despite conclusive evidence forwarded to Sebi in the form of original documents, repayment vouchers and receipts
    Sahara says as a market regulator, Sebi does not have the power to regulate unlisted entities. Sebi is looking to sell properties belonging to third parties which have been kept as security with Sebi, even when it has no authority to effect any such sale without the consent of the titleholders of the properties

SEBI trying to ‘siphon off’ investor refund: Sahara - Ref The Sunday Guardian

Sahara India has alleged that market regulator Securities Exchange Board of India (SEBI) is trying to "siphon off money from the funds" deposited by the group for refunding the investors of Sahara India Real Estate Corp Ltd (SIRECL) and Sahara Housing Investment Corp Ltd (SHICL). SEBI has claimed that it has spent close to Rs 60 cr in 2013-14 on locating genuine investors of Sahara group companies Sahara India Real Estate Corp Ltd (SIRECL) and Sahara Housing Investment Corp Ltd (SHICL).
"We have spent a huge chunk of our money on this and we are running out of money now. We had requested the Supreme Court to allow us to use the funds deposited by Sahara India so as we can meet the expenses incurred on this task," said a senior official from SEBI requesting anonymity.
The official explained that SEBI has spent a large amount on not just locating the investors but also on the storage of the documents submitted by Sahara. In an email response to The Sunday Guardian, Sahara India's counsel, Keshav Mohan, stated, "We suspect that this is a highly malicious campaign initiated by SEBI with a very clear intention to siphon off money from the funds that Saharas have deposited with SEBI, purely for the repayment to its investors. It is really unfortunate and unbecoming of a regulator, the way SEBI is blowing hot and cold, both at a time."
He further pointed out that on Thursday, the counsel for SEBI had argued in the Supreme Court that SIRECL and SHICL issues were public issues, while now SEBI has made a plea that Sahara's investors are untraceable. "We ask SEBI to disclose the basis of their contention, else withdraw their statement. The fact is that, when SEBI sent letters to about 20,000 account numbers and did not receive any responses for them, we immediately got affidavits from a large number of such investors and submitted to SEBI the affidavits, authentic Know Your Customer (KYC) documents and photographs of almost all those investors, who the regulator had tried to contact. Those who were already paid, confirmed that they had received redemption of their investments to their full satisfaction," Mohan noted.
In a strong rebuttal to SEBI's allegations, Mohan further added that the market regulator has not been following directions and has not refunded even Rs 1 cr to the investors, in the last 15 months. "It is not known, why SEBI is not following this direction, and why it is only interested in extracting money from Sahara...SEBI's intentions are unfair and acutely malafide."
Mohan also pointed out to the fact that on 4 March, SEBI told the court that it had completed the scanning and digitisation of the 3.03 crore investors' documents provided by Sahara. Therefore the verification process has still not started.
Mohan also recounted that the Minister of State for Finance, Namo Narayan Meena in a reply to a question in Parliament had said that the money given by Sahara is for refund to the investors only and the money would not be utilised for any other purpose. "The money received by SEBI will only be used for the repayment of the investors and till now SEBI has only refunded only Rs 1 cr. This is a sinister attempt by SEBI to eat away investors' money. Till now, in Saharas' case SEBI has not shown any intention to protect the interest of investors, for which it has been constituted... we will not let SEBI make this another Golden Forest Case where investors have still not got their hard earned money and will stand and fight till the end in the interest of our investors."

Subrata Roy Is A Patriotic Man: Kapil Dev On Sahara Chief'S Arrest

Former Indian cricket captain Kapil Dev has expressed concern over the arrest of Sahara Group chief Subrata Roy and hoped that an "extremely patriotic person" like him will come out of this situation soon.
"In Bangladesh, I came to know though TV channels that Saharasri has surrendered and is in police custody. I have known him as an extremely patriotic man who has done so much for the country. I wish that he comes out of this situation soon," Kapil said in a letter addressed to the media.
Roy was arrested on Friday by Uttar Pradesh police after non-bailable warrant was issued by the Supreme Court for his failure to appear before it in a case of non-refund of Rs 20,000 crore to investors. He would be produced before the apex court on March 4.
Roy has been kept at Kukrail guest house in Lucknow following court orders.
Kapil, the 1983 World Cup-winning captain, said he has known Roy for a long time and that he tried getting in touch with Sahara Group chairman and his wife after his arrest.
"I have tried hard to call him, but could not get in touch with him nor his wife. In the same context, I contacted a senior worker of Sahara as I was very worried for a possible negative reaction of Sahara Workers, for I know very well that his workers take him as their God," said Kapil.
Kapil said he wrote the letter, supporting Roy, in the best interest of the country.
"This I share in the best interest of the people of the country."

 As Sahara India Parivaar has selflessly help people in all displeasing sorrows and calamities.
The market regulator SEBI buck of blaming Sahara of not paying OFCD (Optionally Fully Convertible Debentures) is wrong. The scheme got successful in the year 2006 under the observation of Registrar of the companies. With the time frame Sahara had cleared the liability of 29991 Crores.  I am shocked to see there no people claiming for money. Isn’t it looking like some tactics to behold the Sahara efforts? Isnt it surprising that the market regulator gives one statement in the parliament and another in the court.
Isnt it surprising that in the last 16 months there has been no verification from SEBI for the pertaining case. I think Sahara can file the defamation case on SEBI for tarnishing their brand image.
The reflection of good deeds never goes in vain for the support of Subhrato Roy Ji the Bollywood stars  like Jitendraji, Ramesh Sippy and cricket celebrities like Kapil Dev spoke their hearts out. This is a real a true spirit of portraying humanness and supporting in the largest employer of India. 
 In the past also, the cries of Uttrakhand were heard by Sahara. This was only one incident where Sahara team has put in their efforts. Sahara gives their active support in every unforbidden events thus willingly fulfils its corporate social responsibility. Truth personified: I have always got timely returns on my investments

I am investor myself from last 10 years; though my capital investment was low the company gave me the equal opportunity to invest which did lot of savings and great aid to secure my family.
I solely trust the future perceptions of the company and I personally feel that their huge scope of growth in the competitive markets. Some misconceptions will not stop me from rely my faith in the company. I feel it is some unclear strategies of political parties to let the team spirit down and fix the Pariwar in fate, but soon the team will come up with the solutions. Mr Subrata Roy faith for the judicial system will do justice with the company and will give equal chance to clarify the misconceptions.
The tailor made deposit schemes are securing the earning of many investors. In the OCD debentures also Sahara had informed the investors about the regulations by using the broadcast medium. What can the group do if SEBI does not want to clears the air?  Sahara has always shown its willingness to give the proof of documents that says the larger chunk of amount is repaid and talk to the media.
With the faith of many investors, Sahara in no time became the number one non residuary banking company.  The present allegations have left the country amazed. 
I hope Sahara clears the bad times soon. The deposit mobilisation entity of the workers is the trend setting example of the civic society.

Yesterday when I was watching T.V, I Saw in the news of Sahara Chief arrest, the flashing of news reminded me about the earthquake on 2001 in Kutch.
I am the survivor of the intense earthquake; our home was totally damaged with the earthquake. My uncle and my cousin aunty was stucked under the debris. I cried for help and locals come to rescue.  With the efforts of locals the kartvyayogi and members of the Sahara Team came with the emotional Support.
The close call with the death was shocking; unlike us there were many other people willing to get rescue. Thanks to the noble efforts of Sahara, the people were successfully relocated at the safer places.
Receiving the medical aid within shorter time was great. Sahara took no time in binding the hearts of the survivors by making the relief camps.  The past days the proactive kartyayogi and members of the team did a great job. The noble deed of the Sahara Pariwar thought us a historic lesson of helping every human in difficult times.
The good deeds of Sahara were less recognised by the Media, but the group never complained about it and humbly continued to carry on its patronage. It is shocking to see that in SEBI- Sahara Case, even if the amount is being paid the Sahara India Pariwar is being targeted and victimized.
It’s my Pay-back time I can never forget their good work and help they did for me and my community in Kutch. Being socially responsible, I gladly thank the man with noble vision and with whole heartedness I extend my support for Sahara India Pariwar keeping up hope of every citizen of India.  I hope the difficult days will shed away soon and Sahara will again emerge back with the flying colours.

Earlier also Sahara has expressed his interest in paying the refunds to the investors and has the paid the larger chunk of the money estimating of about Rs 29991 Crores and small portion of 2260.69 are left.
Why is Sahara Chief brutally interrogated? When the SEBI has not even Started verifying the truckloads of proofs. Is it the tactics of influential market regulator or spoiling the brand image, but the good work will pay off soon and give proper justice to the responsible Indian Citizen Subrato Royji.

As a sports lover, I am indebted to Sahara for its contribution to Indian sports. This group has done what India's sports management bodies could not do -- Promote sports in true spirit. Sahara has made its presence felt in all leading sports in the country, be it cricket, hockey, badminton, wrestling, boxing, archery, track field events, tennis and not to forget the high-profile F1. The group has invested unprecedented amount of money in sponsorship of sports personalities and teams, ensuring that sportspeople get world-class facilities to train and hone their skills. Saharasri Subrata Roy - The True Social Worker ! Salute To Him !

I am reluctant to write about the ongoing Sahara-SEBI case as it is a subjudiced matter. However, I am bound to ponder on the personality of Mr. Subrata Roy Sahara. I have been searching for information about him online. I have read about him on Sahara's website and all that the mighty google throws up. What caught my eye is the fact that this man does not talk about making money and earning profits, unlike the way other businessmen do. He talks more of collective materialism, profit sharing, improving the standard of living, and most importantly the nation. 


Why wouldn't he talk of profiteering like the Ambanis, Birlas, Tatas, and what have you? This is perhaps because he has built this empire for the love of India and its citizens. To help the poor who want avenues to park their little savings, to help poor families in organising marriage of their daughters, to arrange for a world-class medical treatment for those who cannot afford it. He does all this not because he is forced to but because he wants to. He is a man that should have been given a red carpet welcome at the President House and not put in jail for doing something that was allowed in law.

Sahara Group To Invest Rs 32,400cr; Offer 56k New Jobs

NEW DELHI: Sahara group, whose legal battle with Sebi continues in Supreme Court over refund of over Rs 20,000 crore to investors, has made a surprise announcement of plans being afoot to hire over 56,000 new employees this year along with investments to the tune of nearly Rs 32,400 crore. 
In three-page newspaper advertisements, the group has invited applications for senior positions across business verticals within and outside country and said that these more than 56,000 new jobs need to be filled by the end of 2014. 
At the same time, it has also claimed that the group, which calls itself Sahara India Parivar, is "committed to creating four lakh salaried positions in next three years". 
The businesses for which job applications have been invited include FMCG& retail, dairy, poultry, luxury real estate and lifestyle, food factory, low-cost housing, CSR, education and even cruises (Sahara Water Homes). 
Besides job details, the group also disclosed specific investment targets for at least four business verticals and these investments total to an amount of Rs 32,394 crore. 
For its 'Luxury Retail: Sahara Global Mastercraft Ltd' business, the group said that an investment of Rs 1,400 crore would be made over five years, while Rs 5,172 crore would be invested in Food & Beverages and Entertainment: QSR (Quick Service Restaurants). 
Its 'International Business: Macedonia (Europe)' business is expected to see an investment of Rs 13,922 crore in dairy project and Rs 9,600 crore in hospitality project. 
Further, healthcare would seen an investment of Rs 2,300 crore for 5-7 years, according to the public notice. 
The group also claimed a huge asset base with a market value of "Rs 1,52,518 crore" and a land bank of 36,631 acres. 
This massive recruitment drive comes at a time when the group is caught in a legal battle with Sebi, which had charged it of raising over Rs 24,000 crore through various "illegalities" in issuance of certain bonds through two firms. 
These two firms -- Sahara India Real Estate Corp Ltd (SIREC) and Sahara India Housing Investment Corp Ltd (SHIC)-- were asked to refund the money to investors, while the Supreme Court also asked the group to comply with Sebi orders. 
Sahara group later deposited Rs 5,120 crore with Sebi and claimed that it was way above the outstanding amount due to be returned to investors as more than Rs 20,000 crore were already refunded directly. 
The Supreme Court has refused to allow Sahara Group chief Subrata Roy to leave the country till the companies provide details of refunding Rs 20,000 crore to investors. 
The apex court last week asked the group to furnish all the documents to reveal the source of Rs 22,885 crore which it claims to have refunded to the investors.
Besides, the group was directed to place all documents including the bank statements sought by Sebi before February 11 when the court would take up the case for further hearings.

Unanswered Questions Raised By Sebi-Sahara Battle - Ref TOI

The legal battle between market regulator Sebi and Sahara India is expected to enter a decisive round in the New Year. The Supreme Court is soon expected to hear a review petition by the Sahara group, while Sebi is reportedly preparing to move the apex court in case Sahara fails to deposit the court-directed amount with the regulator.
Over the next few months the battle is sure to involve some of the country's top legal minds. TOI reviewed court papers, opinions given by former judges, and orders of some of the cases that dealt with similar cases to try and discern what's at the core of the dispute and how it has been handled. Sebi and Sahara officials declined to comment on TOI's queries, saying the matter was sub judice.
At the core of the dispute is whether Sebi or the ministry of corporate affairs (MCA) has jurisdiction over fund raising activities by two unlisted Sahara group entities, Sahara India Real Estate Corp (SIRECL) and Sahara Housing Investment Corp (SHICL), through the private placement route. Also, whether raising money from more than 50 people, even if through the private placement route, is construed as public offering or not, because all public offers require Sebi's permission.
For perspective, here are the facts of the case. Sahara started the offering in 2001 and closed it in 2007. Subsequently, it submitted its prospectus giving details of 1.97 crore investors to the concerned Registrar of Companies (RoC). The number of investors, above 50, was not objected to by the authorities. Then in 2008, the two companies took permissions again from two different RoCs to raise funds through optionally fully convertible debentures (OFCDs), through the private placement route and raised money from about three crore investors, all of whom were claimed to be people associated with the Sahara group.
In 2009, when Sahara Prime City, one of the group companies approached Sebi to go public, the regulator suddenly asked SIRECL and SHICL to refund all the OFCD money to investors. That began the battle.
In April 2010, Sebi forwarded some OFCD investor complaints to RoCs in UP and Maharashtra. In its letter Sebi said that these Sahara companies were unlisted and had not filed prospectus for raising funds with it, and requested the two RoCs "for examination (of the complaints) and necessary action" 
Around this time, in another case relating to an unlisted entity, Sebi said that its primary mandate was over listed entities, and requested MCA to look into allegations against unlisted companies. Around the same time, backed by inputs from an executive director of Sebi, MoS finance Namo Narayan Meena told the LokSabha that privately placed debentures by unlisted companies, issued under the Companies Act, were under the regulatory purview of MCA and not Sebi.
In this period, four former judges, V N Khare and A H Ahmadi, both former SC chief justices, S P Kurudkar, who was also in the SC and C Achutan, who was a member of SAT, gave separate opinions saying that MCA had the jurisdiction over OFCDs issued by SIRECL and SHICL. 
In February 2011, law minister VeerappanMoily gave an opinion to MCA that the jurisdiction over the two Sahara companies was not of Sebi's but of MCA. Mohan Parasaran, additional solicitor general, also noted that Sebi had no jurisdiction over unlisted companies such as the two Sahara companies which don't intend to get listed. Ashok Nigam, another ASG, also held that the central government remains the regulating authority for the two Sahara companies, not Sebi. Parasaran also mentioned the contrary view of his colleague ParagTripathi who had agreed with Sebi's action and disagreed with the Law Ministry. Parasaran ended his opinion saying that he, however, agreed with the views of the Law Ministry. 
Now, on the question of whether the OFCD offer to more than 50 people was a public issue, the SC has recently ruled that they come under Sebi's jurisdiction. However, in 2007 Sahara had reported that there were 1.97 crore investors for its first issue and no one had objected. In addition, post this discloser, two RoCs had allowed Sahara to issue fresh OFCD issues. 
The flip-flop in the case raises some questions: 
►If with government permission a business is done for 11 years, can the rules be changed and the entity punished with retrospective effect? 
►Can a regulator give one statement in Parliament and after a few months give a contradictory statement through an affidavit in court? 
►Can Sebi state through a letter to RoC that an entity is not under it and RoC should take action, but after seven months contradict itself and issue prohibitory orders against the same entity saying it was under its purview and not MCA, the nodal ministry for RoC? 
In late 2011, Sebi and Sahara had their first showdown in the Allahabad high court. The battle then moved to the SC where in August 2012 Sahara was asked to refund about Rs 25,000 crore to its OFCD holders. Last week, Sahara moved the apex court again pleading that its total liability towards OFCD holders was only about Rs 2,620 crore and this was reducing steadily as the group was paying off the investors. 
It also said that it has kept aRs 2,500 crore buffer for final verification. 
An apex court bench has agreed to hear the petition on Monday, setting the stage for the next twist in this fascinating battle.

About Sahara's Cash Transactions

At the hearing on 11.2.2014 a lot was made out of the fact that Sahara has been raising money in cash and one sided story has been presented yet. Sahara’s image and credibility has been severely affected where 12 lacs families earn their lively hood.
The fact is that most of our investors are small. In OFCD our average investment amount is Rs.8,000/-, around 98% investors are below 19,000/- and starts from Rs.500/-. Mostly these people do not go to Bank and banks also do not reach to them.
So these investors deposits in cash and essentially want to take back in cash.
Here it is very important, to understand, as per many global and country's institution's study that in India about only 50% population have access to Bank accounts.
Sahara India a Partnership Firm has infrastructure throughout the country with more than 4700 offices with lakhs of workers. Sahara was and is doing agency work/providing infrastructure services to Housing Finance, Mutual Benefit, Residuary Non Banking, OFC Debentures in 3 companies from 2001, Credit Co-operative Society and in non financial activities collects booking, then installments of Housing, Consumer Products etc. etc.
At our branches and service centre of Sahara India, right from the beginning the strict, convenient, safe, cost effective policy was adopted that is in one premises of “Sahara India” whatever money comes in a day from different constitution’s businesses should be first utilized for that day’s all payments including establishment expenses, secured loans, prematurities, maturities, redemption, etc and it is settled constitution wise at head quarter level.
The above strict policy was, followed due to following reasons amongst others: a. We lost few lives of our workers who used to take money from branches to banks or from banks to branches (more dangerous in this situation). It happened hundreds of times where these workers faced snatching, robberies, few had died many had serious injuries and many more had minor injuries. Our workers always feel scared to take money to deposit into the bank or from bank to offices and it is definitely not possible cost wise to provide one-two gun mans at more than four thousands of branches.
b. If policy would have been to get all the collected money from branches to Head Quarter and then again sending back to the branches for payments it would cost us huge amount of bank charges and also loss of interest would have been very big amount and that too on continuous basis and again life risks etc. to take money from bank to office and very importantly our very, -very strict timely payments rule would have been effected.
About heavy payments in short period, SEBI does not want to understand the spread of our network into 4700 centers. If carefully calculated it will be found branch average payments per day is around 2.5 Lakhs.
SEBI has repaid around Rs.70 Lakhs in last 17 months out of 5120 Crores deposited to SEBI by us. SEBI totally ignored Hon'ble Courts order and has not initiated one verification out of 3 Crore investors in last 17 months and last few months totally avoiding to report the valuation of our assets submitted to them. We are very happy Hon'ble Court has ordered them this time to come out with the valuation report.
